4. Your Responsibilities
- Provide accurate and complete information when contacting us or applying for offers
- Ensure you have rights to any content you supply
- Review drafts and provide timely feedback
- Use our site and services lawfully — no scraping, hacking, or disruption
5. Content Ownership & Approvals
- You retain ownership of your content (text, logos, images, videos)
- You grant us a licence to use your content for project delivery
- We may showcase completed work in our portfolio unless you request otherwise in writing
6. Intellectual Property
- We retain ownership of our pre-existing code, templates, and design systems
- Upon payment (if applicable), you receive a licence to use the delivered work for your business
- Third-party libraries are governed by their respective open-source licences
7. Hosting, Domains & Third-Party Services
- For free websites, hosting and domain fees are paid directly to the provider by you
- We may recommend providers, but they operate under their own terms
- We are not liable for outages or issues caused by third-party services
8. Warranties & Disclaimers
- We deliver services with reasonable care and skill
- We do not guarantee uninterrupted or error-free operation
- All services are provided “as is” to the extent permitted by Australian law
9. Limitation of Liability
- Our total liability is limited to the fees paid for services in the 3 months prior to any claim
- We are not liable for indirect losses, lost profits, or data loss
10. Compliance Responsibilities
- You are responsible for your business’s legal and industry compliance (e.g. trade licences, advertising standards, privacy notices)
- We can assist with adding your policies to your website if you provide the content
11. Payment & Cancellation (Paid Projects)
- Invoices are due upon receipt unless otherwise agreed
- Late payments may result in paused work or support
- Either party may cancel a project with written notice. You will be invoiced for work completed to date
12. Free Website Offer
Scope: Up to 5 pages, mobile-friendly, SEO-ready, contact form, and Google Analytics setup
Exclusions: Advanced features, branding, large-scale content writing, e-commerce, ongoing support
Selection: Limited spots available each month
Ownership: You own the finished site. We transfer access upon completion
13. Paid Care Plans
- You may cancel a care or support plan with 30 days’ written notice
- We will provide admin login and transfer credentials upon cancellation
- Third-party service contracts remain your responsibility
- Prepaid fees are non-refundable unless required by law
14. Changes to These Terms
We may update these Terms & Conditions. The latest version will be posted on our website. Continued use of our services indicates acceptance of any changes.
15. Governing Law
These terms are governed by the laws of Victoria, Australia. Any disputes will be handled by the courts of Victoria.
